The Secretary of State (SOS) Eric Pickles has dismissed an appeal concerning wind turbine development in the setting of a humble Grade II listed warehouse building, on land adjacent to Louth Canal, near Tetney, Lincs, concluding that it is ‘not far short of substantial harm’, while also giving much weight to the recent Court of Appeal ruling on Lyvedon New Bield.
It is notable also that the appeal was ‘recovered’ by the SoS, so he, not the Inspector, has made the final decision.
The decision letter reports that the ‘Secretary of State has carefully considered the Inspector’s reasoning and conclusions [[and] agrees with the Inspector’s conclusion… that there would be considerable harm to the significance of the Grade II listed Thoresby Warehouse which falls not far short of substantial harm, largely because of the erosion of the prominence of the building and its canal side way-marking function which would be seriously diminished by the proposed development. The Secretary of State agrees with the Inspector’s comments about Tetney Church and like him notes that the ES and English Heritage do not set out any significant harm in respect of the setting of this listed building…’
