Now that the Historic Environment (Wales) Bill has entered the Detailed Committee Consideration stage, amendments may be tabled to the legislation. The Welsh Government has taken the opportunity to table 45 amendments to the Bill. A few will make necessary corrections to a handful of errors or omissions that escaped the notice of the Bill team prior to introduction. The majority of the amendments, however, are proposing changes that will further clarify the drafting, introduce greater consistency or refine the presentation of the law. Fourteen of the amendments, for instance, are concerned with simplifying the drafting relating to purchase notices in section 109 and schedule 9 of the Bill. Explanations of the purpose and effect of all the Government amendments are provided in a table available on the Committee website.
Some of the tabled amendments reflect changes to the Bill suggested by stakeholders. Amendments, for example, have been proposed to the definition of a “listed building” in section 76(5) to clarify that structures or artificial objects included within a listing must be ancillary to the listed building in line with case law. An amendment to section 97 has also been tabled to provide clarity about the conditions that may be imposed for recording if consent is given for the demolition of a listed building. The Legislation, Justice and Constitution Committee will meet on 13 February for its Detailed Committee Consideration session on the Bill.
