IHBC launches new ToolBox Guidance Note on the ‘Stripey House’ case and S.215 Notices

Following the recent decision of the High Court to allow the candy-coloured stripes to be retained on an unlisted house in a Kensington conservation area – the ‘Stripey House’ – the IHBC has published a short guidance note to clarify the operation of Section 215 Notices (regarding Land Adversely Affecting Amenity of Neighbourhood) and the external decoration of buildings, explaining how the High Court concluded that a requirement to alter a lawful painting scheme was an improper use of S.215 as there was no suggestion that maintenance or repair of the building was deficient.

Bob Kindred, IHBC Research co-ordinator and author of this Guidance Note, said: ‘This case received widespread publicity but its details are not dwelt on in great detail in the Note.  Instead we look at the origin of S.215 Notices and how that shaped decisions such as the case of the ‘Stripey House’.’

IHBC Director Seán O’Reilly said: ‘IHBC Research Notes are produced as part of an integrated resource offering online support for conservation practitioners, the IHBC’s ‘Toolbox’.’

‘The Toolbox has been developed to help inform, advise and guide anyone with specialist interests in built and historic environment conservation.  Already it offers a wide range of basic resources – the ‘tools’ in the toolbox – from primary research and guidance produced by or on behalf of the IHBC, to technical, academic and practice advice supported or endorsed by the institute.’
