IHBC consultation response: Proposal for regulations required by the HE (Wales) Act 2016 and guidance documents

Consultation Wales GovJ an2017The Welsh Government consulted on these proposals and the IHBC Consultation Panel found that while the imposition of costs might deter unreasonable behaviour in designation reviews, those in receipt of the designation on their property may not understand that it will only apply where they have acted unreasonably.

The Panel generally agreed:

  • with the grounds of review for designations of scheduled monuments and listed buildings
  • that a request for a review should be made within 3 months of receipt of a notice of designation
  • that Managing Change to Registered Historic Parks and Gardens in Wales helped owners and their agents to manage historic parks and gardens to achieve high-quality, sensitive change
  • that the draft guidance, Managing Historic Character in Wales, clearly explained what historic character is
  • that the draft guidance, Managing Historic Character in Wales, gave sufficient information to support the effective management of historic character

The Panel generally disagreed:

  • with the measures proposed for the award of costs to deter unreasonable behaviour in designation reviews
  • that the draft statutory guidance, Historic Environment Records in Wales: Compilation and Use
    • clearly set out the roles and responsibilities of the relevant public bodies
    • gave the relevant public bodies adequate guidance on how they may contribute to the compilation of historic environment records
    • clearly set out how the relevant public bodies should use the historic environment records in the exercise of their functions
  • that the draft guidance, Managing Listed Buildings at Risk in Wales, supported the more effective management of historic buildings at risk
  • that the advice on condition, use and ownership contained in the draft guidance, Managing Listed Buildings at Risk in Wales, covered the key issues
