Following an extensive process of discussion and advice, the IHBC has welcomed Historic England’s withdrawal of its Advice Note on Curtilage, pending imminent consultation on a revised version.
IHBC Chair James Caird and Policy Committee Chair Roy Lewis issued the following joint statement:
‘A large number of IHBC members across the country raised concerns regarding the original Advice Note, particularly its implications for farm buildings within the curtilage of listed farmhouses. In response, the IHBC obtained Legal Opinion that questions the legal basis of the advice, and we are very pleased to see that the Note is to be re-considered by Historic England, including through a substantive consultation process.’
‘Furthermore, the advice on curtilage on the Historic England web-page relating to listed buildings has been amended and now draws attention to a case in Calderdale that, in the Legal Opinion offered to us, represents critical leading precedent regarding case law on curtilage.’
‘This is very welcome news and we are delighted that Historic England has taken this action.’
