Cornish homes consent in AONB quashed by judge

A High Court judge has quashed planning permission granted by Cornwall Council for a 31-home development at Mevagissey in an Area of Outstanding Natural Beauty (AONB), as Mr Justice Hickinbottom ruled that the planning committee had not given enough weight to alternative sites in Mevagissey which would have had significantly less impact on the designated AONB.

Planning Portal writes:
The legal challenge was fronted by the local parish council with financial support from residents and the Cornwall AONB Partnerships, which includes organisations such as the National Trust.

In a statement the planning authority said: ‘The council notes the judgment. As a result the application will now return to the Council to re-determine.’
