CLG: ‘working with the applicant’ to be LPA statutory duty

Department for Communities and Local Government (CLG) chief planner Steve Quartermain has written to England’s Chief Planning Officers stating that from 1 December 2012 it will be a requirement for local planning authorities (LPAs) to ‘include a statement on every decision letter stating how they have worked with the applicant in a positive and proactive way, in line with the NPPF’.

A Statutory Instruments laid in Parliament on 6 September, requires that a ‘notice of decision or determination relating to a planning application… shall include a statement explaining how, in dealing with the application, the local planning authority have worked with the applicant in a positive and proactive manner based on seeking solutions to problems arising in relation to dealing with a planning application…’

The duty will come into force on 1 December 2012.
