{"id":9795,"date":"2015-03-18T14:01:38","date_gmt":"2015-03-18T14:01:38","guid":{"rendered":"http:\/\/ihbconline.co.uk\/newsachive\/?p=9795"},"modified":"2015-03-18T10:35:31","modified_gmt":"2015-03-18T10:35:31","slug":"proposals-to-overhaul-section-106s-unveiled","status":"publish","type":"post","link":"https:\/\/newsblogs.ihbc.org.uk\/?p=9795","title":{"rendered":"Proposals to overhaul section 106s unveiled"},"content":{"rendered":"<p><span style=\"text-decoration: underline;\">Planning minister Brandon Lewis has proposed new measures to speed up section 106 agreements including the creation of a dispute resolution service involving an external body or a \u2018suitably qualified individual\u2019.<\/span><\/p>\n<p>The minister is consulting on plans to speed up the s106 process so applications can be decided more quickly and ensuring work starts sooner on site.<\/p>\n<p>The proposals include:<\/p>\n<ul>\n<li>Setting clear time limits so section 106 negotiations are completed in line with the existing 8 to 13 week target for planning applications to be processed<\/li>\n<li>Requiring parties to start discussions at the beginning of the planning application process, rather than the current system where negotiations can often start towards the end<\/li>\n<li>A dispute resolution process where negotiations stall preventing development<\/li>\n<li>Using standardised documents to avoid agreements being drafted from scratch for each and every application<\/li>\n<li>Potential legislation in the next Parliament to give the new measures teeth<\/li>\n<\/ul>\n<p>Lewis said: \u2018Section 106 planning agreements can bring great benefits to local communities but too often they drag out planning applications for months.\u2019<\/p>\n<p>In terms of dispute resolution the Government is interested in views on an automatic or \u2018deemed\u2019 regime as well as one involving a service with charges, one which is not part of the conventional appeals system.<\/p>\n<p>Also under discussion is whether the requirement to provide affordable housing contributions acts as a barrier to development providing dedicated student accommodation.<strong>\u00a0<\/strong><\/p>\n<p><a href=\"https:\/\/www.gov.uk\/government\/consultations\/section-106-planning-obligations-speeding-up-negotiations\" target=\"_blank\">See the consultation<\/a><\/p>\n<p><a href=\"http:\/\/www.planningportal.gov.uk\/general\/news\/stories\/2015\/Feb15\/260215\/260215_1\" target=\"_blank\">Search Planning Portal<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Planning minister Brandon Lewis has proposed new measures to speed up section 106 agreements including the creation of a dispute resolution service involving an external body or a \u2018suitably qualified individual\u2019.
