{"id":9668,"date":"2015-02-27T18:05:07","date_gmt":"2015-02-27T18:05:07","guid":{"rendered":"http:\/\/ihbconline.co.uk\/newsachive\/?p=9668"},"modified":"2015-02-27T18:05:07","modified_gmt":"2015-02-27T18:05:07","slug":"ebay-style-online-dispute-resolution-for-small-claims-on-the-way","status":"publish","type":"post","link":"https:\/\/newsblogs.ihbc.org.uk\/?p=9668","title":{"rendered":"Ebay style Online Dispute Resolution for small claims on the way?"},"content":{"rendered":"<p><span style=\"text-decoration: underline;\">Members involved in construction work may be interested to know about ideas for new proposals to deal with small claims; a three tier online dispute resolution process (HM Online Court) has been proposed by the Civil Justice Council in a report prepared by Professor Richard Susskind OBE, Chair of Civil Justice Council\u2019s Online Dispute Resolution Advisory Group and IT Adviser to the Lord Chief Justice.<\/span><\/p>\n<p><span style=\"text-decoration: underline;\">The Courts and Tribunals Judiciary writes:<br \/>\n<\/span>A new Online Dispute Resolution (ODR) system should be developed in England and Wales to increase access to justice and to streamline the court process, a report recommends today.<\/p>\n<p>The report, by a working group of the independent Civil Justice Council (CJC), calls for a dedicated state-run \u2018Online Court\u2019 to operate alongside the traditional court system, and invites the support of all political parties.<\/p>\n<p>The report\u2019s principal author, Professor Richard Susskind, said;<br \/>\n\u2018This report is not suggesting improvements to the existing system. It is calling for a radical and fundamental change in the way that our court system deals with low value civil claims. Online Dispute Resolution is not science-fiction. There are examples from around the world that clearly demonstrate its current value and future potential, not least to litigants in person.\u00a0 On our model, an internet-based court would see judges deciding cases online, interacting electronically with parties. However, our suggested online court has a three tier structure, and we expect most disputes to be resolved at the first two stages without a judge becoming involved.\u2019<\/p>\n<p>The report recommends that Her Majesty\u2019s Courts and Tribunals Service (HMCTS) set up a pilot as soon as is practicable with a view to rolling out an online court based on the findings.<\/p>\n<p>Lord Dyson, the Master of the Rolls (and Chairman of the Civil Justice Council) said: \u2018This an important and timely report. There is no doubt that ODR has enormous potential for meeting the needs (and preferences) of the system and its users in the 21st Century. Its aim is to broaden access to justice and resolve disputes more easily, quickly and cheaply.
