{"id":9219,"date":"2014-12-27T15:10:09","date_gmt":"2014-12-27T15:10:09","guid":{"rendered":"http:\/\/ihbconline.co.uk\/newsachive\/?p=9219"},"modified":"2014-12-19T19:21:49","modified_gmt":"2014-12-19T19:21:49","slug":"right-to-light-review-published","status":"publish","type":"post","link":"https:\/\/newsblogs.ihbc.org.uk\/?p=9219","title":{"rendered":"\u2018Right to Light\u2019 review published"},"content":{"rendered":"<p><span style=\"text-decoration: underline;\">The Law Commission has now published its final report with recommendations on reform into the \u2018right for light\u2019 affecting developments in England and Wales<\/span>.<\/p>\n<p><span style=\"text-decoration: underline;\">The Law Commission writes<\/span>:<br \/>\nWe commenced this project in March 2012 and published a consultation paper on 18 February 2013.\u00a0 We have now published our final Report, Rights to Light (Law Com No 356), which contains our recommendations for reform.<\/p>\n<p>Our key recommendations are:<\/p>\n<ul>\n<li>a statutory notice procedure which would allow a landowners to require their neighbours to tell them within a specified time if they intend to seek an injunction to protect their right to light, or to lose the potential for that remedy to be granted;<\/li>\n<li>a statutory test to clarify when courts may order damages to be paid rather than halting development or ordering demolition;<\/li>\n<li>an updated version of the procedure that allows landowners to prevent their neighbours from acquiring rights to light by prescription;<\/li>\n<li>amendment of the law governing where an unused right to light is treated as abandoned; and<\/li>\n<li>a power for the Lands Chamber of the Upper Tribunal to discharge or modify obsolete or unused rights to light.<strong>\u00a0<\/strong><\/li>\n<\/ul>\n<p><a href=\"http:\/\/lawcommission.justice.gov.uk\/publications\/rights-to-light.htm\" target=\"_blank\">Press release and documentation\u00a0<\/a><\/p>\n<p><a href=\"https:\/\/newsblogs.ihbc.org.uk\/?p=3099\" target=\"_blank\">IHBC newsblogs on Law Commission proposals<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Law Commission has now published its final report with recommendations on reform into the \u2018right for light\u2019 affecting developments in England and Wales.
