{"id":5998,"date":"2013-06-22T15:21:50","date_gmt":"2013-06-22T15:21:50","guid":{"rendered":"http:\/\/ihbconline.co.uk\/newsachive\/?p=5998"},"modified":"2013-06-22T15:21:50","modified_gmt":"2013-06-22T15:21:50","slug":"supreme-court-to-rule-on-landmark-village-green-case","status":"publish","type":"post","link":"https:\/\/newsblogs.ihbc.org.uk\/?p=5998","title":{"rendered":"Supreme Court to rule on landmark village green case"},"content":{"rendered":"<p><span style=\"font-size: 16px;\"><span style=\"text-decoration: underline;\">The Open Spaces Society and members of Helredale Neighbourhood Council (HNC) in Whitby, North Yorkshire have welcomed the news that an application to register Helredale playing fields as a village green will be heard in the Supreme Court<\/span>.<\/span><span style=\"font-size: 16px;\">\u00a0<\/span><\/p>\n<p>The application for a green was rejected by the Court of Appeal last October, having previously been rejected by the registration authority, North Yorkshire County Council, following a public inquiry.<\/p>\n<p>The Court of Appeal ruled that because the land was acquired under the Housing Act 1936 it was not eligible for registration.<\/p>\n<p>Viv Wright, secretary of HNC, said: \u2018When we started this application over six years ago, we never dreamed that we would end up before the Supreme Court.<\/p>\n<p>\u2018The outcome is likely to have a significant impact on village green applications in future.
