The owner of chemical giant ICI’s former headquarters in Stockton-on-Tees has won permission to take its fight to save the building from demolition to the Appeal Court, citing a violation of the European Convention on Human Rights.<\/span><\/p>\n

\u00a0<\/strong><\/p>\n

A DECISION on whether to demolish the derelict Billingham House will now lie in the hands of the country\u2019s top judges as owners Bizzy B have won permission to take its case to the Civil Appeal Court in London, where lawyers will argue Stockton Council\u2019s stance on demolition is \u2018irrational\u2019 and a violation of the Human Rights Convention.<\/p>\n

The council was given permission to demolish the former ICI Headquarters in a High Court ruling last August.\u00a0 Pre-demolition work was carried out but structural dismantling was unable to proceed while legal actions continued. Lord Justice Kay, presiding over the appeal, granted Bizzy B permission to pursue its case to a full Appeal Court hearing to be heard by mid-May.<\/p>\n

Today Councillor Mike Smith, Stockton Council\u2019s Cabinet Member for Regeneration and Transport, said he was disappointed at the ruling adding: \u2018My feelings particularly go out to the residents of Billingham who have had to endure this blot on the landscape for years. For their sake, we want to see it removed as quickly as possible.\u2019<\/p>\n

Gerard Clarke, for Bizzy B, told the hearing the 1960s property could be \u2018restored to its former glory\u2019 and used for businesses, leading to regeneration.\u00a0 He said: \u2018Bizzy B\u2019s position is that saving the building would be a reasonable thing to do and would be in the public interest as well as being in the interest of the council as a potential recipient of rates<\/a> income.\u2019<\/p>\n

He said: Bizzy B and developers, Python Properties, had a \u2018viable and achievable\u2019 plan to regenerate Billingham House.<\/p>\n

 <\/p>\n

Lord Justice Kay refused permission for Bizzy B to pursue claims that the council\u2019s decision to grant planning permission for the demolition was flawed.<\/p>\n
