{"id":28533,"date":"2020-12-08T17:12:01","date_gmt":"2020-12-08T17:12:01","guid":{"rendered":"https:\/\/newsblogsnew.ihbc.org.uk\/?p=28533"},"modified":"2020-12-08T17:12:01","modified_gmt":"2020-12-08T17:12:01","slug":"befs-seeks-help-on-cultural-heritage-protection-definitions-post-brexit","status":"publish","type":"post","link":"https:\/\/newsblogs.ihbc.org.uk\/?p=28533","title":{"rendered":"BEFS Seeks help on cultural heritage protection &#038; definitions post-Brexit"},"content":{"rendered":"<h3><a href=\"https:\/\/newsblogs.ihbc.org.uk\/wp-content\/uploads\/2020\/07\/BEFS_new.png\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-full wp-image-26912\" src=\"https:\/\/newsblogs.ihbc.org.uk\/wp-content\/uploads\/2020\/07\/BEFS_new.png\" alt=\"\" width=\"300\" height=\"295\" \/><\/a>BEFS is looking for help in contacting MSPs about concerns over the Draft UK Withdrawal from the European Union (Continuity)(Scotland) Bill\u2019s definition of \u2018environment\u2019, which currently excludes cultural heritage, not only weakening environmental protections for the historic environment but also for being inconsistent with both Scottish and EU legislation.<\/h3>\n<p><!--more--><\/p>\n<p>BEFS writes:<\/p>\n<p>The definition of \u201cenvironment\u201d within the amended\u00a0<a href=\"https:\/\/beta.parliament.scot\/-\/media\/files\/legislation\/bills\/current-bills\/uk-withdrawal-from-the-european-union-continuity-scotland-bill-2020\/stage-2\/bill-as-amended-at-stage-2-uk-withdrawal-from-the-european-union-continuity-scotland-bill.pdf\">draft\u00a0<em>UK Withdrawal from the European Union (Continuity)(Scotland) Bill<\/em><\/a>\u00a0is currently inconsistent with both Scottish and European legislation and it may weaken environmental protections for cultural heritage. The wording proposed following Stage 2 of the Bill\u2019s progress introduces a new definition which could result in future legal challenge.<\/p>\n<p>To fully align with the\u00a0<em>Environmental Assessment (Scotland) Act 2005<\/em>, referred to in sections 11 and 13 of the draft Bill , we would recommend that the definition of \u201cenvironment\u201d should be amended to match that found in\u00a0<a href=\"https:\/\/www.legislation.gov.uk\/asp\/2005\/15\/schedule\/3\">Schedule 3<\/a>, Section 6 of the 2005 Act which fully aligns with Annexe II of\u00a0<a href=\"https:\/\/www.legislation.gov.uk\/eudr\/2001\/42\/pdfs\/eudr_20010042_adopted_en.pdf\">Directive 2001\/42\/EC<\/a>\u00a0of the European Parliament.<\/p>\n<p>We would propose the following amendments to ensure continued protection for cultural heritage and for consistency across Scottish legislation:<\/p>\n<p>In section 12, page 10 line 14 leave out subsections 2, (a) and (b) and insert \u2013<\/p>\n<p>(a) means biodiversity, population, human health, fauna, flora, soil, water, air, climatic factors, material assets, cultural heritage, including architectural and archaeological heritage, landscape, and<\/p>\n<p>(b) the inter-relationship between the issues in (a)<\/p>\n<p>In section 40, page 23, line 19, leave out subsections (3) (a) and (b) and insert\u2014<\/p>\n<p>(a) means biodiversity, population, human health, fauna, flora, soil, water, air, climatic factors, material assets, cultural heritage, including architectural and archaeological heritage, landscape, and<\/p>\n<p>(b) the inter-relationship between the issues in (a)<\/p>\n<p>If you would like to protect Scotland\u2019s cultural heritage, please do share the above with your MSPs.
