{"id":28530,"date":"2020-12-08T17:06:47","date_gmt":"2020-12-08T17:06:47","guid":{"rendered":"https:\/\/newsblogsnew.ihbc.org.uk\/?p=28530"},"modified":"2020-12-08T17:06:47","modified_gmt":"2020-12-08T17:06:47","slug":"lawyers-examine-legality-of-planning-approval-for-stonehenge-tunnel","status":"publish","type":"post","link":"https:\/\/newsblogs.ihbc.org.uk\/?p=28530","title":{"rendered":"Lawyers examine legality of planning approval for Stonehenge Tunnel"},"content":{"rendered":"<h3><a href=\"https:\/\/newsblogs.ihbc.org.uk\/wp-content\/uploads\/2020\/12\/NewCivilEngineer_081220.png\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-full wp-image-28531\" src=\"https:\/\/newsblogs.ihbc.org.uk\/wp-content\/uploads\/2020\/12\/NewCivilEngineer_081220.png\" alt=\"\" width=\"300\" height=\"258\" \/><\/a>Opponents of the Stonehenge Tunnel have instructed lawyers to examine the legality of transport secretary Grant Shapps\u2019 decision to give the scheme the green light.<\/h3>\n<p><!--more--><\/p>\n<p>New Civil Engineer writes:<\/p>\n<p>Save Stonehenge World Heritage Site, a new organisation set up by The Stonehenge Alliance, has instructed law firm Leigh Day to investigate the lawfulness of the\u00a0<a href=\"https:\/\/www.newcivilengineer.com\/latest\/stonehenge-tunnel-gets-planning-green-light-12-11-2020\/\">decision to approve the A303 scheme.<\/a><\/p>\n<p><a href=\"https:\/\/www.newcivilengineer.com\/latest\/planning-inspectorate-advised-against-stonehenge-tunnel-approval-due-to-heritage-concerns-16-11-2020\/\">Shapps approved the scheme\u2019s development consent order (DCO) application earlier this month, overruling the official recommendation made by the Planning Inspectorate to reject the plans.<\/a><\/p>\n<p>Stonehenge Alliance president Tom Holland said: \u201cI fully back the move to test whether Grants Shapps acted legally in approving this highly wasteful and destructive road scheme.<\/p>\n<p>\u201cThe Government has ignored advice from both Unesco and the independent panel who presided over a six month examination. To have won the arguments based on reason and evidence, and then to have them overruled on a ministerial whim, shows just how broken the roads approval process is.<\/p>\n<p>\u201cI urge everyone who cares about the Stonehenge World Heritage Site (WHS) to support this legal action. There is still a chance to stop the bulldozers moving in and vandalising our most precious and iconic prehistoric landscape.&#8221;<\/p>\n<p>In its final recommendation report, the Planning Inspectorate\u2019s Examining Authority concluded that the \u00a31.7bn project would cause &#8220;substantial harm&#8221; to the Stonehenge site.<\/p>\n<p>The Examining Authority said the \u201cadverse impacts\u201d of the scheme would \u201cstrongly outweigh its benefits\u201d.<\/p>\n<p>Its report adds: \u201cThe effect of the proposed development on the outstanding universal value of the WHS would lead to substantial harm to the significance of the designated heritage asset. In addition, there would be considerable harm to landscape character and visual amenity.<\/p>\n<p>\u201cThere would also be modest harm arising from the \u2018loss of view of the stones\u2019 and limited harm to individuals and individual businesses and companies.&#8221;<\/p>\n<p>Highways England has been progressing the procurement process for the main works contract for the A303 scheme.
