after the authority&#8217;s executive voted in favour of the proposed way forward, which could take up to two years.<\/p>\n<p class=\"HasContent\">A compulsory purchase order is a legal function in the United Kingdom and Ireland which allows certain bodies to obtain land or property without the consent of the owner.<\/p>\n<p class=\"HasContent\">A repairs notice was served to the private owner of the pier, CNM Estates, in September 2019, advising the proprietor that repair work must take place.<\/p>\n<p class=\"HasContent\">Since then, no substantive proposal for repairs or any evidence of action being taken was received by the council.<\/p>\n<p class=\"HasContent\">Historic England has allocated a grant to the council of \u00a3127,000 to investigate options and seek potential partners.<\/p>\n<p class=\"HasContent\">The council wants partners to come forward and work towards a long-term solution.<\/p>\n<p class=\"HasContent\">Speaking at the meeting, deputy leader Mike Bell said: &#8220;This is the beginning of exploring the compulsory purchase order and finding partners from the private or voluntary sector to work with us.<\/p>\n<p class=\"HasContent\">&#8220;We are serious and committed to make things happen and we want a sustainable future for the pier and island.&#8221;<\/p>\n<p class=\"HasContent\">The council agreed to take steps with interested parties &#8216;to seek to acquire the necessary interests in land by agreement, including negotiation of headline terms, undertakings, transfers and any new rights required&#8217;.<\/p>\n<p class=\"HasContent\">The executive also agreed to engage with any party with an interest in Birnbeck Pier with a view to securing agreement for its preservation.<\/p>\n<p class=\"HasContent\">The grade-II listed pier&#8217;s condition is deteriorating and consequently it is a top priority on Historic England&#8217;s heritage at risk national register.<\/p>\n<p class=\"HasContent\">It is considered to be a nationally important structure which is &#8216;at imminent risk of being lost because of neglect, decay or inappropriate development&#8217;.<\/p>\n<p class=\"HasContent\">The purchase order will be submitted to the Secretary of State for confirmation.<\/p>\n<p class=\"HasContent\">The Secretary of State will have to be satisfied there is a compelling case in the public interest generally for the compulsory purchase to proceed.<\/p>\n<p><a href=\"https:\/\/www.thewestonmercury.co.uk\/news\/birnbeck-pier-to-be-purchased-by-north-somerset-council-1-6499729\" target=\"_blank\" rel=\"noopener\">Read more&#8230;.<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>North Somerset Council could buy Birnbeck Pier, writes The Weston Mercury, after agreeing to explore the potential of a compulsory purchase order (CPO).<\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[1],"tags":[],"class_list":["post-25485","post","type-post","status-publish","format-standard","hentry","category-ihbc-newsblog"],"_links":{"self":[{"href":"https:\/\/newsblogs.ihbc.org.uk\/index.php?rest_route=\/wp\/v2\/posts\/25485","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/newsblogs.ihbc.org.uk\/index.php?rest_route=\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/newsblogs.ihbc.org.uk\/index.php?rest_route=\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/newsblogs.ihbc.org.uk\/index.php?rest_route=\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/newsblogs.ihbc.org.uk\/index.php?rest_route=%2Fwp%2Fv2%2Fcomments&post=25485"}],"version-history":[{"count":1,"href":"https:\/\/newsblogs.ihbc.org.uk\/index.php?rest_route=\/wp\/v2\/posts\/25485\/revisions"}],"predecessor-version":[{"id":25487,"href":"https:\/\/newsblogs.ihbc.org.uk\/index.php?rest_route=\/wp\/v2\/posts\/25485\/revisions\/25487"}],"wp:attachment":[{"href":"https:\/\/newsblogs.ihbc.org.uk\/index.php?rest_route=%2Fwp%2Fv2%2Fmedia&parent=25485"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/newsblogs.ihbc.org.uk\/index.php?rest_route=%2Fwp%2Fv2%2Fcategories&post=25485"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/newsblogs.ihbc.org.uk\/index.php?rest_route=%2Fwp%2Fv2%2Ftags&post=25485"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
