However, over years of changing\u00a0<a class=\"mw-redirect\" title=\"Property owner\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Property_owner\">property owners<\/a>\u00a0and\u00a0<a class=\"mw-redirect\" title=\"Occupant\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Occupant\">occupants<\/a>,\u00a0<a title=\"Boundary\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Boundary\">boundaries<\/a>\u00a0can be moved, diverted, adjusted and even overgrown.<\/p>\n<p>While the legal\u00a0<a title=\"Boundary\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Boundary\">boundary<\/a>\u00a0line will always be indicated on the\u00a0<a class=\"mw-redirect\" title=\"Land registry\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Land_registry\">Land Registry<\/a>\u00a0<a title=\"Title\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Title\">Title<\/a>\u00a0Plan, often these will be to a very small\u00a0<a title=\"Scale\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Scale\">scale<\/a>, usually 1 to 1,250. In\u00a0<a title=\"Practice\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Practice\">practice<\/a>, this means that when a\u00a0<a title=\"Surveyor\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Surveyor\">surveyor<\/a>\u00a0attempts to determine the\u00a0<a title=\"Boundary\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Boundary\">boundary<\/a>\u00a0line using\u00a0<a class=\"mw-redirect\" title=\"Land registry\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Land_registry\">Land Registry<\/a>\u00a0<a title=\"Title\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Title\">Title<\/a>\u00a0Plan\u00a0<a title=\"Scale\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Scale\">scale<\/a>, there can be as much as a one metre-wide\u00a0<a class=\"mw-redirect\" title=\"Uncertainty\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Uncertainty\">uncertainty<\/a>.<\/p>\n<p>The\u00a0<a class=\"mw-redirect\" title=\"Party wall\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Party_wall\">Party Wall<\/a>\u00a0etc\u00a0<a title=\"Act\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Act\">Act<\/a>\u00a01996 was passed to prevent\u00a0<a class=\"mw-redirect\" title=\"Party wall\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Party_wall\">party wall<\/a>\u00a0<a class=\"mw-redirect\" title=\"Disputes\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Disputes\">disputes<\/a>\u00a0and to protect the\u00a0<a title=\"Owner\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Owner\">owners<\/a>\u00a0of the neighbouring\u00a0<a title=\"Premises\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Premises\">premises<\/a>. It sets out an\u00a0<a title=\"Owner\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Owner\">owner\u2019s<\/a>\u00a0obligations and responsibilities for the\u00a0<a class=\"mw-redirect\" title=\"Works\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Works\">work<\/a>\u00a0that may have an effect on other people&#8217;s\u00a0<a title=\"Property\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Property\">property<\/a>. It provides a\u00a0<a title=\"Framework\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Framework\">framework<\/a>\u00a0to prevent and resolve the\u00a0<a class=\"mw-redirect\" title=\"Disputes\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Disputes\">disputes<\/a>\u00a0with regards to the\u00a0<a title=\"Boundary\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Boundary\">boundary<\/a>\u00a0<a class=\"mw-redirect\" title=\"Walls\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Walls\">walls<\/a>,\u00a0<a class=\"mw-redirect\" title=\"Party wall\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Party_wall\">party walls<\/a>\u00a0and any\u00a0<a title=\"Types of excavation\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Types_of_excavation\">type of excavation<\/a>\u00a0near the neighbouring\u00a0<a title=\"Building\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Building\">buildings<\/a>.<\/p>\n<p>According to this\u00a0<a title=\"Act\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Act\">act<\/a>, there are three primary types of\u00a0<a class=\"mw-redirect\" title=\"Party wall\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Party_wall\">party walls<\/a>:<\/p>\n<ul>\n<li>A\u00a0<a class=\"mw-redirect\" title=\"Walls\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Walls\">wall<\/a>\u00a0that stands on the\u00a0<a title=\"Land\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Land\">lands<\/a>\u00a0of more than one\u00a0<a title=\"Owner\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Owner\">owner<\/a>\u00a0and forms one part of a\u00a0<a title=\"Building\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Building\">building<\/a>.<\/li>\n<li>A\u00a0<a class=\"mw-redirect\" title=\"Walls\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Walls\">wall<\/a>\u00a0that stands on the\u00a0<a title=\"Land\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Land\">lands<\/a>\u00a0of two\u00a0<a title=\"Owner\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Owner\">owners<\/a>\u00a0without being part of any\u00a0<a title=\"Building\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Building\">building<\/a>\u00a0on the\u00a0<a title=\"Land\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Land\">land<\/a>.<\/li>\n<li>A\u00a0<a class=\"mw-redirect\" title=\"Walls\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Walls\">wall<\/a>\u00a0that is on the\u00a0<a title=\"Land\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Land\">land<\/a>\u00a0of one\u00a0<a title=\"Owner\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Owner\">owner<\/a>, however, it is being used by two or more\u00a0<a title=\"Owner\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Owner\">owners<\/a>\u00a0to separate their\u00a0<a title=\"Building\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Building\">buildings<\/a>.<\/li>\n<\/ul>\n<p><strong><span id=\"Reasons_behind_party_wall_disputes\" class=\"mw-headline\">Reasons behind\u00a0<a class=\"mw-redirect\" title=\"Party wall\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Party_wall\">party wall<\/a>\u00a0<a class=\"mw-redirect\" title=\"Disputes\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Disputes\">disputes<\/a><\/span><\/strong><\/p>\n<p>A\u00a0<a class=\"mw-redirect\" title=\"Disputes\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Disputes\">dispute<\/a>\u00a0may arise due to\u00a0<a class=\"mw-redirect\" title=\"Failure\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Failure\">failure<\/a>\u00a0to comply with the\u00a0<a class=\"mw-redirect\" title=\"Party wall\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Party_wall\">Party Wall<\/a>\u00a0etc.\u00a0<a title=\"Act\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Act\">Act<\/a>. For example, you may send a written\u00a0<a title=\"Notice\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Notice\">notice<\/a>\u00a0to the\u00a0<a title=\"Owner\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Owner\">owner<\/a>\u00a0of the adjoining\u00a0<a title=\"Property\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Property\">property<\/a>\u00a02-12 months before starting any type of\u00a0<a class=\"mw-redirect\" title=\"Works\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Works\">work<\/a>\u00a0on the\u00a0<a class=\"mw-redirect\" title=\"Walls\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Walls\">wall<\/a>. The\u00a0<a title=\"Neighbour\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Neighbour\">neighbour<\/a>\u00a0is supposed to provide written consent to the\u00a0<a class=\"mw-redirect\" title=\"Works\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Works\">work<\/a>\u00a0outlined on the\u00a0<a title=\"Notice\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Notice\">notice<\/a>\u00a0within 14 days. You are in deemed to be in\u00a0<a class=\"mw-redirect\" title=\"Disputes\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Disputes\">dispute<\/a>\u00a0if your\u00a0<a title=\"Neighbour\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Neighbour\">neighbour<\/a>\u00a0fails to do this.<\/p>\n<p>A\u00a0<a class=\"mw-redirect\" title=\"Party wall\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Party_wall\">party wall<\/a>\u00a0<a class=\"mw-redirect\" title=\"Disputes\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Disputes\">dispute<\/a>\u00a0may not always be acrimonious. A\u00a0<a class=\"mw-redirect\" title=\"Property owner\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Property_owner\">property owner<\/a>\u00a0may fail to respond to a written\u00a0<a title=\"Notice\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Notice\">notice<\/a>\u00a0due to various reasons. Your\u00a0<a title=\"Neighbour\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Neighbour\">neighbour<\/a>\u00a0also has the right to legally\u00a0<a class=\"mw-redirect\" title=\"Disputes\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Disputes\">dispute<\/a>\u00a0a\u00a0<a title=\"Notice\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Notice\">notice<\/a>\u00a0in order to ensure that this\u00a0<a class=\"mw-redirect\" title=\"Works\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Works\">work<\/a>\u00a0has no adverse effect on their interests and to avail the legal protection of an award.<\/p>\n<p><strong><span id=\"Preventing_party_wall_disputes\" class=\"mw-headline\">Preventing\u00a0<a class=\"mw-redirect\" title=\"Party wall\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Party_wall\">party wall<\/a>\u00a0<a class=\"mw-redirect\" title=\"Disputes\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Disputes\">disputes<\/a><\/span><\/strong><\/p>\n<p>The current\u00a0<a title=\"Occupier\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Occupier\">occupier<\/a>\u00a0of a\u00a0<a title=\"Property\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Property\">property<\/a>\u00a0may not be its legal\u00a0<a title=\"Owner\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Owner\">owner<\/a>. Therefore, it is prudent to use the \u2018HM\u00a0<a class=\"mw-redirect\" title=\"Land registry\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Land_registry\">LAND REGISTRY<\/a>\u00a0ONLINE SEARCH\u2019 to\u00a0<a title=\"Access\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Access\">access<\/a>\u00a0a \u2018<a title=\"Title\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Title\">title<\/a>\u00a0register\u2019 or \u2018<a title=\"Title\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Title\">title<\/a>\u00a0summary\u2019, as it enables you to find the legal\u00a0<a title=\"Owner\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Owner\">owner<\/a>\u00a0of any\u00a0<a title=\"Property\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Property\">property<\/a>\u00a0before sending a\u00a0<a title=\"Notice\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Notice\">notice<\/a>.<\/p>\n<p>Discussing your plans with the\u00a0<a title=\"Owner\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Owner\">owner<\/a>\u00a0of the adjoining\u00a0<a title=\"Property\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Property\">property<\/a>\u00a0is the easiest way to resolve any\u00a0<a class=\"mw-redirect\" title=\"Party wall\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Party_wall\">party wall<\/a>\u00a0<a class=\"mw-redirect\" title=\"Disputes\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Disputes\">dispute<\/a>. It is important, to be honest about how this\u00a0<a class=\"mw-redirect\" title=\"Works\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Works\">work<\/a>\u00a0may affect the\u00a0<a title=\"Property\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Property\">property<\/a>\u00a0and the\u00a0<a class=\"mw-redirect\" title=\"Measure\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Measure\">measures<\/a>\u00a0that you are willing to take to\u00a0<a class=\"mw-redirect\" title=\"Mitigate\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Mitigate\">mitigate<\/a>\u00a0this effect and\/or to rectify any\u00a0<a class=\"mw-redirect\" title=\"Damages\" href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Damages\">damage<\/a>.
