\"DBW<\/a>Using references such as the RICS\u00a0Rights of light: Practical guidance for chartered surveyors in England and Wales<\/a><\/em>, Designing Buildings Wiki (DBW) \u2013 host partner of the IHBC\u2019s Conservation Wiki \u2013 offers a briefing on \u2018Rights to light\u2019 that IHBC members can both review as a \u2018CPD boost\u2019 and, where registered with DBW, enhance on the basis of their own experience.<\/h3>\n

DBW writes:<\/p>\n

The\u00a0right to light<\/a>\u00a0in the\u00a0UK<\/a>\u00a0goes back to general property law relating to\u00a0easements<\/a>\u00a0that date back to the rule of William IV. The Ancient Lights Law was superseded by the 1832 Prescription Act.<\/p>\n

Rights to light\u00a0generally become an issue when a new development, or proposed development affects the access to light of an adjoining property.\u00a0Rights to light\u00a0also apply to obstructions caused by\u00a0trees<\/a>, hedges and so on, but there are no\u00a0rights to light\u00a0for open ground.<\/p>\n

Rights to light\u00a0can be the result of ‘easements<\/a>‘, or can be \u2018nuisance<\/a>\u2019 issues.<\/p>\n

Private\u00a0nuisance<\/a>\u00a0regulates interference with a persons right to enjoy land, or some right in connection with that land. Such interference must be \u2018unreasonable\u2019 to constitute\u00a0nuisance<\/a>. Nuisance<\/a>\u00a0can be remedied by an injunction,\u00a0abatement<\/a>\u00a0and\/or\u00a0damages<\/a>.<\/p>\n

An\u00a0easement<\/a>\u00a0is a right which a person has over land owned by someone else. An\u00a0easement<\/a> can be created by express grant (for example it may be set out in a conveyance\u00a0deed<\/a>), by\u00a0necessity<\/a>\u00a0(for example if there is only one means of access to a site) or by prescription (the act has been repeated for at least 20 years).<\/p>\n

Easements<\/a>\u00a0are normally attached to the land. In relation to\u00a0rights to light, an\u00a0easement<\/a>\u00a0can perpetuate even if a new building is constructed. This means that it cannot be assumed that no\u00a0rights to light\u00a0exist simply because neighbouring buildings appear to be new.<\/p>\n
