The Ancient Lights Law was superseded by the 1832 Prescription Act.<\/p>\n<p>Rights to light\u00a0generally become an issue when a new development, or proposed development affects the access to light of an adjoining property.\u00a0Rights to light\u00a0also apply to obstructions caused by\u00a0<a href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Trees\">trees<\/a>, hedges and so on, but there are no\u00a0rights to light\u00a0for open ground.<\/p>\n<p>Rights to light\u00a0can be the result of &#8216;<a href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Easements\">easements<\/a>&#8216;, or can be \u2018<a href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Nuisance\">nuisance<\/a>\u2019 issues.<\/p>\n<p>Private\u00a0<a href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Nuisance\">nuisance<\/a>\u00a0regulates interference with a persons right to enjoy land, or some right in connection with that land. Such interference must be \u2018unreasonable\u2019 to constitute\u00a0<a href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Nuisance\">nuisance<\/a>. <a href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Nuisance\">Nuisance<\/a>\u00a0can be remedied by an injunction,\u00a0<a href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Abatement\">abatement<\/a>\u00a0and\/or\u00a0<a href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Damages\">damages<\/a>.<\/p>\n<p>An\u00a0<a href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Easement\">easement<\/a>\u00a0is a right which a person has over land owned by someone else. An\u00a0<a href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Easement\">easement<\/a> can be created by express grant (for example it may be set out in a conveyance\u00a0<a href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Deed\">deed<\/a>), by\u00a0<a href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/NEC\">necessity<\/a>\u00a0(for example if there is only one means of access to a site) or by prescription (the act has been repeated for at least 20 years).<\/p>\n<p><a href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Easements\">Easements<\/a>\u00a0are normally attached to the land. In relation to\u00a0rights to light, an\u00a0<a href=\"https:\/\/www.designingbuildings.co.uk\/wiki\/Easement\">easement<\/a>\u00a0can perpetuate even if a new building is constructed.
